Definitions:
The Client : The company or individual requesting the services of untitledtm.
untitledtm: Primary designer/site owner & employees or affiliates.

General:

1. The release of artwork will  be calculated at the time of request.
2. For late payments we will use at our discretion the Late Payment of Commercial Debts (Interest) Act 1998. We will also add a charge for administration under section 5A of the Late Payment of Commercial Debts (Interest) Act 1998. For more details please visit Business Link here. For information on how we will calculate the interest and compensation please click here. Interest will be charged at the statutory 8 per cent plus the Bank of England base rate. At our discretion we reserve the right to apply additional interest to cover any interest applied by our bank (Barclays), which at the time of publication is 0.07% calculated on a daily basis.
   
3. untitled™  will carry out work only where an agreement is provided either by email, telephone, mail or fax. An 'order' is deemed to be a written or verbal contract between untitled™ and the client, this includes telephone and email agreements.

Product Specific Terms for Subscription websites:

1. Work will not proceed unless a payment method is in place and the first payment has been received.
2. By making your first payment you are agreeing to the 24 month contract which then turns into a rolling contract.
   

Website Design

1. Whilst every endeavor will be made to ensure that the website and any scripts or programs are free of errors, untitled™  cannot accept responsibility for any losses incurred due to malfunction, the website or any part of it.
2. untitled™ cannot take responsibility for any copyright infringements caused by materials submitted by the client. We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material.

Website Hosting

1. untitled™ provides a premium hosting service with monitoring and data backup however untitled™ cannot accept liability for losses caused by the unavailability, malfunction or interruption of this service, or for loss of turnover, sales, revenue, profits or indirect, consequential or special loss.

Copyrights and Trademarks

1. The client represents to untitled™ and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to untitled™ for inclusion into any webpages or artwork are owned by the client, or that the client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend untitled™ and its subcontractors from any claim or suit arising from the use of such elements furnished by the client.

Copyright to Web Pages

1. While your site is within its subscription period, untitled™ owns the Copyright to all pages.
2. Once your site is completed and you have paid the balance of any invoices the copyrights are then transferred to you.
